By placing an order with Dolfin Digital you confirm that you understand, agree and are bound by the terms and conditions set out below.

Definitions

The client: The company or individual requesting the services of Dolfin Digital

Dolfin Digital: The owners, employees or associates of Dolfin Digital

Clients: Dolfin Digital reserves the right to choose who we accept as a client and may not offer our services to all potential clients where we feel it would not be in the interest of Dolfin Digital or appropriate.

General

Dolfin Digital will carry out work when an order has been placed or requested by the client and an agreement has been reached.

An “order” is a written or verbal agreement between the client and Dolfin Digital. This includes telephone, email and in person agreements.

Cost of services

An estimate or quote for work will usually be given but not restricted to written communication. This may be a verbal quote in some cases and where ongoing work is requested by the client. Dolfin Digital will not usually charge more than the estimated cost unless additional work or services is requested by the client beyond the scope of the estimated cost.

In which case a quote will be given for additional work either verbally or written.

Credit

Dolfin Digital do not usually provide credit and only in some circumstances will credit be offered and only when this has been agreed prior to any work or services undertaken. If credit is offered there will usually be a charge for this in the form of interest on the amount of credit given. This would be explained in the agreement you make with Dolfin Digital. We take unauthorised credit seriously and may charge late payment fees as well as interest. Credit would be deemed unauthorised if a client on completion or on part completion delayed the launch or handover of a website or services without settling the outstanding account. Or was unable to clear the account balance on completion of the project.

Website design services

Whilst Dolfin Digital makes every effort to ensure that the website, programs, applications or scripts that are used have been tested, checked and are error-free, Dolfin Digital cannot be held responsible for any losses or damage incurred by malfunction of the website or any part of it. The design of the site, any graphics, programming code, or applications used remain the property of Dolfin Digital until all outstanding accounts are paid in full and the website is handed over to the client. In some cases the programming code or applications used may remain the property of Dolfin Digital unless a prior agreement has been made.

Dolfin Digital will provide a provisional home page graphic for the client to view and approve. Changes may be made within reason at this stage without cost. However once approved and the site is built, changes made to the design and structure of the website or additional work that is requested may incur further charges. Dolfin Digital will inform or provide a quote to the client prior to any charges being applied to the account.

Schedule of work and timescales

Dolfin Digital will provide the client with an estimated timescale and inform the client when the project will be scheduled. Dolfin Digital will normally require some notice to schedule work in and this timescale may vary. Whilst every effort is made to complete projects within the timescale given this may not always be possible. The client understands that timescale may vary dependant on whether Dolfin Digital has all the information provided by the client when requested and when the client approves work. Other factures beyond the control of Dolfin Digital may affect the timescale. If work has been scheduled in and this changes for any reason or the client wishes or needs to delay the project or does not have the information required then the project will need to be re-scheduled in.

Search engine friendly

The term search engine friendly means that the website is coded in such a way that it will be recognised by and submitted to the major search engines, that all the appropriate page titles, meta tags, alt tags and meta keywords are placed in the site. This does not guarantee a high ranking within the search engines for search terms other than the domain name. However Dolfin Digital does provide search engine optimisation services for additional cost unless otherwise agreed in the quote or estimate.

Content management Systems

Where the site owner has the facility to manage the content of the website, upload images and change the content and structure of the site Dolfin Digital will not be held responsible or liable for any content added or the use of content and its legality.
Whilst every effort is made to provide training on the use of content management systems Dolfin Digital cannot be held responsible or liable for any loss or damage to the site, its contents or structure. In the unlikely event that loss or damage occurs due to site owner error Dolfin Digital will endeavour to correct the issue, however a charge may be applied the account. Dolfin Digital will provide up to two hours free training on the use of the content management system at the Dolfin Digital office. If additional training or training of other members of the company staff or individuals is required then charges may be applied to the account.

Legalities, copyright and intellectual rights

Dolfin Digital will expect the client to carry out sufficient research that the website, business or idea will operate legally. Any images, media provided to Dolfin Digital by the client including logos is the responsibility of the client to ensure that they are not infringing any copyright or intellectual rights and, where appropriate, permission is gained. Dolfin Digital will not be held responsible for the use of illegal images or intellectually protected rights. We reserve the right to remove any website, images or media thought to be operating illegally.

The client agrees to make available and provide any material needed to complete the project in a timely and accurate manner. Dolfin Digital will not be held responsible for any losses, cost involved or compensation due to failure to meet deadlines.
Dolfin Digital will not be liable or become involved in any disputes between the site owner and their clients or customers and cannot be held responsible for any wrongdoing on the site owner’s part.

Whilst every effort is made to ensure the availability of the website emails or functions of the website, Dolfin Digital cannot be held responsible or liable for any costs incurred, loss of earnings or compensation due to unavailability and reasons beyond the control of Dolfin Digital.

Compatibility, updates, including government legislation

Whilst every effort is made to ensure compatibility and correct functioning of the site at the time of the website build Dolfin Digital cannot be held responsible or predict for incompatibility arising in the future caused by browser updates, programming code updates or government legislation. Whilst any issues or errors will be corrected on request by the client the client understands that there may be a cost and timescale involved. Dolfin Digital will inform the client prior to any work being carried out of any cost.

Client privacy

It is against the policy of Dolfin Digital to make available any private details of the client to any third party outside of Dolfin Digital unless prior agreement has been made with the client either verbal or written or Dolfin Digital is required legally to do so.

Media services

It is the responsibility of the client to ensure that appropriate permission has been obtained prior to ordering media services. This includes the taking of photographs and video.

Hosting

Dolfin Digital provide hosting services through third party vendors. Although every effort is made to ensure the correct functioning and availability of these hosting services including email hosting. Dolfin Digital cannot be held responsible or liable for any loss incurred due to unavailability or incorrect functioning.

Technical support

Dolfin Digital does not provide technical support beyond the scope of the website or offer any advice relating to the clients ability to access the website. For example if the client is experiencing difficulty viewing the website due to internet service provider issues, computer issues or any other issue not relating directly to the website. Dolfin Digital will check that the website is generally available and that there are no known issues but cannot help beyond this.

Email set up

Dolfin Digital will set up email accounts on the server and provide a web mail login and details of the account(s) including server settings to the client. However Dolfin Digital cannot offer any technical assistance or advice in configuring email accounts on client devices nor be held responsible in the functioning or any issues arising from use of emails on these devices.

Domain names

Dolfin Digital provide domain name registration services though third party vendors and cannot be held responsible for any loss incurred due to unavailability or incorrect functioning.

Payment

A non-refundable deposit will usually be requested on order of work or services and must be paid within seven days of the order unless otherwise agreed. The amount of deposit may vary depending on the size and nature of the project and this will be set out in the agreement between the client and Dolfin Digital.

Invoices for work carried out must be paid within seven days unless otherwise agreed.

Cancellation of services

Once an agreement has been made between Dolfin Digital and the client Dolfin Digital reserves the right to request the remaining balance to be paid in full. In the event of cancellation of services depending on what stage the project is in for example if the website is complete and built then Dolfin Digital may ask for the balance to be paid in full to cover costs (unless otherwise agreed).

Late payments

If late payments reminders are issued then a charge may be applied to the clients account. If the account is not settled within seven days of the reminder then interest may also be applied to the account unless otherwise agreed with good reason.
If the account is not settled after these seven days then Dolfin Digital may pass the matter on to our company solicitor for consideration.

Complaints procedure

In the unlikely event that the client has cause for complaint the client may email outlining the cause for the complaint to us and the matter will be closely examined and decided whether there is grounds for complaint. Dolfin Digital will endeavour to correct any grounds for complaint within thirty days of receipt where possible and appropriate.

Courtesy

Dolfin Digital expects clients to show due respect and courtesy when communicating with members of staff at Dolfin Digital and to be polite at all times. Clients can expect the same from members of staff.
